1. General provisions

  1. This Privacy Policy (hereinafter referred to as the “Privacy Policy”) specifies the method

processing of personal data necessary to perform the services provided through the “Moja Okolica” application (hereinafter referred to as the “Application”). The service is provided free of charge and is intended to be used as is. If you choose to use our Service, you consent to the collection and use of information in connection with this policy. The personal data we collect is used to provide and improve the Service. We will not use or share your information with anyone except as described in this Privacy Policy. The terms used in this privacy policy have the same meaning as in our terms and conditions, which are available in the Moja Okolica application, unless otherwise stated in this Privacy Policy.

  1. The administrator of personal data is the company S4C Operator Sp. z o.o. based

in Warsaw at Gotarda 9, 02-683 Warszawa, entered into the register of entrepreneurs under the number KRS 0000759028 SĄD REGIONOWY DLA M. ST. WARSAW IN WARSAW, XIII ECONOMIC DEPARTMENT OF THE NATIONAL COURT REGISTER NIP: 5213847496 REGON: 381876889.

  1. The administrator of the S4C Operator company has appointed a Data Protection Inspector in the Company – contact

rodos4c@mcx.pl.

  1. A user is any natural person using the services on a mobile device

provided through the Application.

  1. The user acknowledges that sharing personal data by him is

voluntary. The User will provide the Administrator with personal data

after accepting the Regulations during registration in the Application.

2. data collection

  1. In order to ensure the highest quality when using our Service, we may require you to provide certain personal data, including, but not limited to, your name, telephone number, e-mail address. The information we request will be stored and used by us as described in this privacy policy. The application uses third party services that may collect information to identify you. Link to the privacy policy of external service providers that the application uses:

  • Google Play Services

  • Google Analytics for Firebase

  • Firebase Crashlytics

  • Facebook

  1. Your personal data will be processed for the purpose of:

  • performance of the contract concluded between you and the S4C Operator Company, including providing answers to your inquiries regarding the products and services provided by the Company,

  • internal administrative purposes of the Company, including statistics and internal reporting, which are the implementation of our legitimate interest,

  • archival, which is the implementation of our legitimate interest in securing information in the event of a legal need to prove facts,

  • possible determination, investigation or defense against claims that are the implementation of our legitimate interest,

  • considering complaints, in the event of their being filed, regarding the quality of services provided by the Company and the manner of handling under the contracts performed,

  • direct marketing of the Company’s own products and services.

3. Automatic data

  1. The Administrator does not collect personal data without the User’s consent, but only data

regarding the use of the Application. These data are collected automatically (“data

automatic”).

  1. The automatic data includes:

  • name of the device on which the User uses the Moja Okolica mobile application,

  • device ID in the Moja Okolica system

  • the location of the user’s device

  1. When using our Service, in the event of an application error, we collect data and information (via third party products) on your phone called Log Data. This log data may include information such as the device’s Internet Protocol (“IP”) address, device name, operating system version, application configuration when using our Service, time and date of Service use, and other statistics.

  2. It is not possible to change or delete automatic data.

4. Personal data

  1. The personal data provided directly by the User include:

– First name and last name

– Phone number,

-e-mail adress

  1. Providing these data by the User is voluntary, but they are required to

fully be able to use all available functionalities.

  1. The data will be used only to enable it to be correct, complete and efficient

communication between the Administrator and the User and the implementation of certain functions

Application.

  1. Access to personal data of third parties

Our subcontractors, whom we may hire, may have access to your personal data for the following reasons:

  • To facilitate our Service;

  • To provide the Service on our behalf;

  • Providing services related to the Services; or to help us analyze how our Service is being used.

Third parties have access to your personal data due to the performance of their tasks on our behalf. However, they are obligated not to disclose or use the information for any other purpose.

5. Administrator’s rights and obligations

  1. The Administrator undertakes to process the User’s personal data in accordance with

with legal requirements regarding privacy and personal data protection, i.e .:

  • Regulation of the European Parliament and of the Council (EU) of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation GDPR)

  • Act of 18 July 2002 on electronic provision (Journal of Laws of 2013, item 1422, as amended)

  • The Act of July 16, 2004. Telecommunications law (Journal of Laws of 2014, item 243

as amended)

  1. The administrator guarantees the provision of appropriate technical measures

and organizational ones ensuring the security of personal data processed.

  1. The User’s personal data will be kept for as long as it is necessary to

provision by the Administrator of services provided through the Application.

  1. The Administrator has the right to share the User’s personal data with: subsidiaries; entities providing audit, advisory and consulting services; legal; entities authorized under the law; entities processing data on the basis of a data processing agreement – only in accordance with

with the instructions of the S4C Operator Company.

  1. Personal data will not be transferred outside the European Economic Area.

  2. User rights and obligations

  1. The data processed on the basis of consent may be processed until its withdrawal or when the purpose of processing has been achieved.

  1. Data processed on the basis of the legitimate interest of the data administrator may be processed until the legitimate interests of the S4C Operator Company, which constitute the basis for this processing, are fulfilled or until you object to such processing.

  1. The data processed in connection with the concluded contract will be processed until the expiry of the contract and cover the warranty period and pursuing any claims. Your data used for direct marketing purposes will not be further processed in the event of an objection.

  1. The User has the right to:

  • the right to access personal data and the right to demand their rectification, objection to processing, deletion or limitation of their processing;

  • the right to withdraw consent; withdrawal of consent does not affect the lawfulness of the processing which was carried out on the basis of consent before its withdrawal;

  • the right to transfer personal data, i.e. to receive personal data from the Administrator in a structured, commonly used and machine-readable format (if applicable), in order to possibly transfer the data to another data administrator;

  • the right to lodge a complaint with the supervisory body (the President of the Personal Data Protection Office) dealing with the protection of personal data, when you believe that the processing of your personal data violates the provisions of the Regulation of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in connection with with the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (Journal of Laws UE L 119 of May 4, 2016).

  1. If the User deletes personal data, the User will not be able to use the functions of the Application that use this data.

    7. Data security

  1. We value your trust in us with your personal data, so we strive to use commercially acceptable means to protect it. Please note, however, that no method of transmission over the Internet or method of electronic data storage is 100% secure and reliable, and we cannot guarantee absolute security.

  2. This Service may contain links to other websites. If you click on a third party link, you will be directed to that website. Please note that these external sites are not operated by us. Therefore, we strongly recommend that you read the privacy policies of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third party sites or services.

    8. Privacy policy for children

We do not knowingly collect personal information from children under the age of 13. If we find that a child under the age of 13 has provided us with personal information, we immediately delete it from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we can take the necessary steps.
